User Agreement

PLEASE READ THIS USER AGREEMENT CAREFULLY BEFORE INSTALLING THE GAME SOUL DANCE PARTY

This user agreement with the end user (hereinafter referred to as the „Agreement”) is a public offer (official offer) to an individual/end user and regulates the use of the game Soul Dance Party (hereinafter referred to as the „Game”), currently provided or to be provided by 1C Online Games Ltd. or by any of its parent, subsidiary or affiliated companies, its licensors and / or its beneficiaries (hereinafter referred to as the Administrator).

The Game is a computer program, which is a set of data and commands intended for the operation of computers and other computer devices, hosted on the Administrator's server, including the Server component, the Game Client and the Site.

The Game Client is a computer program that is installed on the User's personal computer and provides interaction with the Server component in order to ensure the gameplay.

The Site is the Internet site of the Game, located at: https://1cgames.net, through a web interface that provides Users with access to information materials and services related to the Game.

The Server component of the Game is a computer program hosted on the Administrator's server and provides interaction between Users of the Game within the game process.

The User is an individual who has concluded this Agreement with the Administrator in accordance with the procedure established in cl. 1 of this Agreement.

The Rules of the Game mean a description of the gameplay of the Game, as well as the conditions for User access to the Game, contained on the Site on the page "Rules of the Game" (1cgames.net/ru/agreements/souldanceparty).

1. Acceptance of the Agreement

1.1 The fact of registration of an individual on the Site and the installing of the Game Client by the User is a full and unconditional acceptance of the terms of this Agreement, as well as the Rules of the Game, and this individual is considered as a person who has entered into contractual relations with 1C Online Games Ltd.

1.2 From the moment of performing the actions provided for in cl. 1.1 of this Agreement, this Agreement is considered to be concluded in writing.

1.3 Any individual who has reached the age of 18 (eighteen) at the time of registration on the Site can become a User. Minors have the right to enter into this Agreement and use the Game only if at the time of submitting an application for registration on the Site there is a consent of their legal representative. Accordingly, the User, by registering on the Site, confirms his majority and legal capacity, and if the User is a minor - the consent of the legal representative. At the request of the Administrator, the User informs the Administrator of the personal (passport) data of the legal representative whose consent to sign this Agreement was received by the User.

2. Subject of the Agreement

2.1 The Administrator provides the User with access to the Game within the framework and on the terms of this Agreement, the Rules of the Game (hereinafter referred to as „Access to the Game”), and also provides the Services for additional fee according to clause 2.3. The Administrator notifies users on the Site about the installation of the next version of the Game. The User agrees that in order to participate in the Game after installing the next version of the Game, it may be necessary to accept a new User Agreement and other mandatory documents posted on the Site. If the User has agreed to automatically update the Game when installing the Game Client, the Game will be updated automatically when the next version of the Game is released.

2.2 Access to the Game is provided to the User to ensure the possibility of further provision of Services to the User for additional fee. As part of granting Access to the Game, the Administrator performs the following actions:

2.2.1 Provides an opportunity for the User to get access to the Game (with the exception of additional functions provided as part of the provision of Services for additional fee), and also provides Services on the terms and with the restrictions defined in this Agreement.

2.2.2 Provides the User with access to the information resources of the Site that are open to Users of the Game, including forums posted on the Site.

2.2.3 Provides the User with technical support (within reasonable limits) in the form of answers to the User's questions in connection with the Game, addressed to the Administrator via the form on the website at: https://1cgames.net/support.

2.3 The Services shall mean the services for providing the User with access by the Administrator to certain additional in-game functions (in-game benefits, items, etc.). The content and cost of Services are determined in the relevant sections on the Game's Site.

2.4 Access to the Game for the purpose of correct reading of this Agreement means the possibility of using the functionality of the Game as part of the gameplay (with the exception of functionality provided in the form of the Services for additional fee) in accordance with this Agreement and the Rules of the Game. The User does not have the right to perform any other actions with respect to the Game and its components, other than those directly stipulated in this Agreement and the Rules of the Game.

2.5 No rights to the results of intellectual activity, including the rights to the Game or its component parts (including the account itself), other than those directly stipulated in this Agreement, are granted to the User. All rights to the Game and its components belong to the Administrator.

2.6 Any information and materials posted by the User on the Website or in social networks (including forums, chats), or addressed by the User to the Administrator, may be freely used by the Administrator within the limits determined by the Administrator. The Administrator has the right to store the specified information/materials for a period determined by the Administrator. The User guarantees that the User's placement of any information and materials on the Site is lawful, and the User has the necessary rights to carry out such placement.

3. The procedure for providing the User with access to the Game and the provision of Services

3.1. The provision of Access to the Game and the provision of Services to the User under this Agreement is subject to the following preparatory actions by the User:

1) familiarization and consent of the User with the Rules of the Game, expressed in the conclusion of this Agreement with the Administrator;

2) performing the registration procedure on the Site, which consists in clicking the "Register" button by the User and filling in the mandatory fields of the registration form located on the main page of the Site, and receiving a notification by the User to the email address upon completion of registration; in this case, the Administrator is not responsible for the completeness and accuracy of the information provided by the User;

3) downloading and installing the Game Client on the User's equipment and acceptance the Agreement for the use of the Game.

3.2. The Registered User is granted access to the Game. In the future, the User may be provided with Services under this Agreement for additional fee.

3.3. The User has the right to purchase certain Services for additional payment in the "Store" section of the Site by depositing funds using the methods available for payment. The Services are considered paid from the moment the Administrator receives a payment confirmation from the system through which the payment was made. The User acknowledges and agrees that the Administrator does not compensate for any expenses of the User, including, but not limited to, expenses related to the transfer of funds to the Administrator. The User does not have the right to purchase in-game values from any third parties, as well as to sell in-game values.

3.4. If the User has any complaints about the content of the Services actually rendered, the User shall immediately notify the Administrator about this through the form at: https://1cgames.net/support at the same time, specifying their identification data, the time of the claims and providing justification for the claims.

3.5. If the Service was not provided or was provided improperly, the User has the right to apply to the Administrator with a claim. The User takes note that the Administrator may not be able to verify the validity of a claim made more than 3 (three) days from the date of its occurrence. The Administrator sends the User his opinion regarding the received claim, and if he finds it justified, eliminates the detected violation. No compensation under this Agreement may exceed the cost of the Service that was not provided or improperly provided.

3.6. The Administrator is not responsible for the condition of the User's technical means if they exclude or restrict the possibility of providing Access to the Game or receiving the Services by the User.

3.7.The User takes note and agrees that the Administrator has the right to change this Agreement, the Rules of the Game, the list and prices for the Services unilaterally by publishing notifications about such changes on the Site and/or by e-mail and/or in the Game Client, while updating the Rules of the Game can be carried out in the current mode without prior notice. The notification is considered to be received by the User one day after the publication of such a notification on the main page of the Site or in the News section and/or on the Site's Forum. The continued participation of the User in the game process means acceptance of the changed terms.

3.8.The User agrees that any elements (objects) of the Game may be added, changed or removed from the Game at any time at the discretion of the Administrator without the User's consent, including in the event of termination of the relevant licenses for the use of these elements (objects). In addition, the Administrator has the right at any time of his choice to make changes to the list and cost of Services by posting the changed information in the relevant sections of the Site.

3.9. The data that can be processed by the Administrator includes the User's email address. The User has the right to access, correct, delete such personal data at any time, withdraw his consent to the processing of personal data. In cases of loss of the User's identification data (login/password) to access the Game, as well as in cases of receipt from the User of a statement about the unauthorized use of identification data or if it is necessary to confirm the consent of the User's legal representatives to access the Game and pay for the Services, as well as in other cases related to the execution of this Agreement, the Administrator has the right to request from the User, and the User agrees to provide some personal data that will be used exclusively for the purpose of executing this Agreement, protection of the property interests of the User and the Administrator for the purposes of executing this Agreement, including, but not limited to, data on the surname, first name, patronymic, gender, age, registered address, contact phone numbers or email addresses, data on the payment details of the User and/or his legal representative in cases where such data is requested by the Administrator and the User provides them. The Administrator has the right to store and process the specified personal data after the termination of the Agreement in order to confirm the fact of concluding an Agreement with the User and its execution by the Administrator during the validity period of this Agreement.

3.10 The Administrator has the right to involve third parties (agents, intermediaries, etc.) in providing Services or making mutual settlements with the User under this Agreement without obtaining the User's prior consent. When paying for Services within the Game, the User undertakes to read and accept the terms of the relevant payment systems and agents in advance.

4. Obligations of the User

In order to properly fulfill the terms of this Agreement, the User shall:

4.1. Perform the actions provided for in cl. 3.1 of this Agreement, including correct performing the User registration procedure on the Site. In case of changes in contact details and other essential information, make timely changes to the registration form, and if it is impossible, notify the Administrator by e-mail via the form at: https://1cgames.net/support with an indication of the User's email address at which the registration was made.

4.2 Strictly comply with the provisions of this Agreement and the Rules of the Game.

4.3. Not to disclose or transfer to third parties your identification data, which can be used to authorize the User on the Server component of the Game and also not to transfer or sell your account on the Site to other third parties.

4.4. Not to use the Access to the Game and Services provided by the Administrator for commercial purposes.

4.5. Not to violate the intellectual property rights of the Administrator, as well as other copyright holders, with respect to the Game and/or any components of the Game (including the Site and the Game Client), in particular, the User has no right to copy, broadcast, distribute, publish, broadcast or cable, bring to general attention and otherwise distribute and reproduce materials (text, graphic, audio, video) located on the Site, without the written consent of the Administrator, certified by the seal and signature of the Administrator.

4.6. Independently familiarize yourself with this Agreement, amendments and additions to this Agreement, which are announced and published by the Administrator on the main page of the Site.

4.7. Independently ensure the technical possibility of using the granted rights and providing Services on its part, including ensuring:

1) availability of the equipment specified in the system requirements of the Game on the Site;

2) availability of access to the Internet;

3) availability of software compatible with the transmission of information over the http protocol.

4.8. Independently save the documents confirming the payment made during the entire period of granting rights and rendering Services.

4.9. Be responsible for obtaining and distributing information using technical means that ensure the possibility of implementing the provided Access to the Game and the Services, in accordance with the current legislation.

4.10. If you participate in the Partner Program - https://1cgames.net/ru/games/souldanceparty/partner -fulfill the conditions of participation in the Partner Program. At the same time, do not use any racist, sexist or any other offensive calls and appeals. Do not use materials from other projects in parallel with ours, unless you have received consent from their creators.

5. Duties of the Administrator

5.1 In order to properly fulfill the terms of this Agreement, the Administrator shall:

5.1.1 Provide the User with Access to the Game and provide the Services, on the terms and with the restrictions provided for in this Agreement and the Rules of the Game.

5.1.2 To maintain the confidentiality of personal data provided by the User, as well as not to transfer contact information about him to third parties (with the exception of persons engaged by the Administrator solely for the purpose of executing this Agreement), if such information is not publicly available at the User's request, except by a court decision or in another manner provided by law. 

5.2 The User acknowledges and agrees that the Administrator's obligations listed in this Agreement fully depend on the proper fulfillment by the User of the terms of this Agreement and the Administrator has the right to refuse the User access to the Game or Services in the cases provided for by the Agreement and the Rules of the Game.

6. Termination of this Agreement

6.1. If the User violates the terms of this Agreement or the Rules of the Game, including if such violation caused damage to the Administrator or third parties (including other participants of the Game), or if there is a threat of causing such damage as a result of the User's actions, the Administrator has the right to unilaterally suspend or terminate this Agreement concluded with this User.

6.2. Using the Game, including the Site, in a way not provided for by this Agreement, or after the termination of this Agreement, entails the User's responsibility for violating the Administrator's copyright on the Game, established by current legislation and international legal norms.

6.3 The Administrator has the right at any time to unilaterally change the procedure for providing access and providing Services within the Game or to terminate further maintenance (launch) of the Game in full or in part, which may entail a change or termination of this Agreement and without the User's prior consent.

7. Liability of the parties

7.1. The User is responsible for all actions related to the use of access to the Game and all possible risks associated with obtaining Services under this Agreement.

7.2. The Administrator is not responsible for any costs and losses of the User, as well as third parties that may have arisen as a result of providing or not providing the User with access to the Game and the provision of Services under this Agreement.

7.3. The Administrator is not responsible for the result of using or the usefulness of access to the Game, Services, as well as for the quality of access to the Server component of the Game via the Internet.

7.4. The User assumes full responsibility for the safety of personal and identification data providing access to the Server component of the Game, as well as for losses that may be caused as a result of unauthorized use of access to such data.

7.5. Under no circumstances shall the Administrator be liable for the User's losses during the period of providing the User with access to the Game and the provision of Services, including those incurred as a result of errors, omissions, interruptions in work, deletion of files, changes in functions, defects, delays in data transmission.

7.6 The Administrator is not responsible for any actions of the User that caused harm to third parties, including the posting of any information by the User on the Site (chat, forum, etc.).

7.7 If the Administrator becomes aware, or there are grounds to believe, that the User is performing any illegal (including fraudulent) actions related to payment for Services in the Game, the Administrator has the right, in addition to suspending or terminating this Agreement, to transmit information to law enforcement agencies for appropriate verification.

7.8 The Administrator does not guarantee the smooth functioning of the Game and the absence of errors in the Game. If errors are found in the Game that have a significant impact on the gameplay, the Administrator will take measures to eliminate them.

8. Extension and amendment of the terms of this Agreement

8.1. This Agreement is valid from the moment of its acceptance by the User in accordance with cl. 1.1 until the moment of termination in accordance with the terms set out in the Agreement.

8.2. This Agreement and the Rules of the Game are official documents of the Administrator. The current version of each of these documents is available on the Site.

8.3. The Administrator has the right to change the terms of this Agreement and the Rules of the Game according to cl. 3.7.

8.4. The User bears the burden of checking for changes to this Agreement, the Rules of the Game and other information related to the Game on the Site.

9. Settlement of disputes

9.1.The User's claims and comments are accepted by the Administrator in writing or electronically (via the form at: https://1cgames.net/support with the indication of identification data, the time of the claim and the justification of the claim). The Administrator has the right to enter into correspondence with the User in order to clarify the nature and reasons for the claims. The Administrator has the right to regard failure to receive a response to his request within three days as a withdrawal of the claim.

9.2. In case of any disputes or disagreements connected with performance of this Agreement, the Parties will make every effort to resolve them through negotiations.

9.3. This Agreement and any dispute, claim or obligation (contractual or non-contractual) arising out of or in connection with it, its subject matter or formation are governed by the legislation of the Republic of Cyprus, unless otherwise required by the laws of the country where the User is ordinarily resident.

10. Additional Terms and Conditions

10.1. The User has the right, at his own discretion, to stop further use of the Game at any time. If the User does not agree with the amended terms of the Agreement, the Rules of the Game, the User is obliged to stop further use of the Game.

10.2. The Administrator has the right to send messages using both the technical means provided under this Agreement and by sending them directly to the User's email address. The Administrator notifies the User that the messages may not be directly related to the Game, but the User has the opportunity at any time to refuse to receive such messages using commands or settings that the Administrator undertakes to provide to the User.

10.3 The User acknowledges that any information and materials provided by the User to the Administrator during the Game can be used by the Administrator at its discretion without paying additional compensation to the User.

11. Force majeure circumstances

11.1. The Administrator is released from liability for full or partial non-fulfillment of obligations under this Agreement, if such non-fulfillment is the result of force majeure ("force majeure"), that is, extraordinary and unavoidable circumstances by the Parties under these conditions, including:

11.1.1. Mass riots;

11.1.2. Prohibitive actions of the authorities;

11.1.3. Natural disasters, fires, catastrophes and other events of a natural or man-made nature;

11.1.4. Power outages;

11.1.5. Global interruptions in the operation of the Internet;

11.1.6. Routing system failures;

11.1.7. Failures in the distributed domain name system;

11.1.8. Failures caused by hacker and DDoS attacks, as well as other illegal actions of third parties;

11.2. The Administrator is obliged, if it is technically feasible, to notify the User by e-mail and (or) by publishing on the main page of the Site about the presence of force majeure circumstances within 7 (seven) days after the moment of their occurrence.

11.3. If the occurrence of the relevant force majeure circumstances directly affected the performance of the Administrator's obligations within the period specified in this Agreement, this period is extended proportionally for the duration of the relevant circumstances.

11.4. If the inability to fulfill the obligations under this Agreement lasts for more than 3 (three) months, this Agreement is considered terminated without compensation for losses.

On the basis of what legal provisions are or may be processed your personal data?
